Festivals/events are governed by legislation and regulations. There are often severe penalties for not complying with these, so you may want to take professional legal advice. Take these regulations into account when you define peoples' roles and responsibilities.

It may be useful to liaise closely with the local council, as they often oversee community and local festivals and events.

The Festival and Event organiser usually has legal liability for the event. Alternatively, a group or committee may share joint responsibility - legally, they are then considered to be 'jointly and severally liable'.

The organising committee for a non-profit event can become a legal entity by forming an incorporated association.

Check that subcontractors and self-employed contractors have the relevant insurance and risk assessment policies. Get copies of these policies and of signed contracts and make sure that they comply with legal requirements and conditions.

  • Security deposits
  • Late completion penalties
  • Trade Descriptions Act
  • Broadcasts/Media
  • Logos/trademarks
  • Duty of Care incorporated with Occupiers Liability
  • Suppliers of Goods and Services
  • Health & Safety
  • Disability Discrimination Act (DDA)
  • Risk Management
  • Food Hygiene Regulations
  • Exhibition Venue Association

Key Points:

  • Get legal advice, eg. from Local Authority, Solicitor, Health & Safety Executive.
  • Check that all aspects of the organisation and operation of the festival/event comply with legal requirements.
  • Make sure that all team members understand the team's legal responsibilities.
